Terms of Service
1. Who we are
AI Marker is a service operated by GuruMe / AI Marker (Harry Lee), based in Republic of Korea. By creating an account or using the service, you agree to these Terms.
2. What the service does
AI Marker uses large language models (currently Anthropic Claude) to produce a draft set of marks and corrections on student exam papers, based on a markscheme you supply. Output is intended as a first-draft assistant for a human teacher, not a replacement for one. You are responsible for reviewing every marked paper before delivering results to students.
3. Your account
- You must provide a valid email and a password of at least 8 characters.
- You are responsible for keeping your password confidential and for all activity under your account.
- One account per person. Don't share accounts. Team accounts may be offered later under a separate plan.
- You may delete your account at any time by emailing support@gurume.kr.
4. Subscription and billing
- Plans are billed monthly in USD via Stripe. Card data is held by Stripe and never touches our servers.
- Each plan has a paper-marking quota per 30-day period. Quota resets on the period anniversary; unused quota does not roll over.
- You can change or cancel your subscription at any time through the "Manage subscription" link in the app, which opens Stripe's Customer Portal.
- Cancellation takes effect at the end of the current billing period. You retain access to your paid tier until then.
- [CLARIFY: refund policy] — pick one and remove this note: e.g. "Refunds are not provided for partially-used billing periods" OR "Pro-rated refunds are available within 14 days of payment by request to support@gurume.kr."
5. Your content (markschemes, student papers)
You retain ownership of everything you upload. By uploading, you grant us a limited licence to process the file solely to deliver marking output back to you, including transmitting it to our AI provider (currently Anthropic) for processing.
You warrant that you have the right to upload any markscheme, question paper, and student work you submit. If you upload third-party copyrighted material (for example, an examiner's official markscheme) without proper licence or fair-use basis, you accept responsibility for any resulting claims. We do not pre-screen uploads. See the Acceptable Use Policy below for details.
6. Our intellectual property
The AI Marker software, prompts, calibration data, marking-style templates, and brand assets are owned by GuruMe / AI Marker. You may use them only as part of the service. No reverse engineering, scraping our prompts, reselling marking output as your own service, or building a competing product on top of our outputs.
7. Service availability and accuracy
We aim for high availability but do not guarantee uptime. AI marking is statistical and will sometimes be wrong; we provide tools (the review screen, override + feedback log) for you to correct it. We accept no liability for marks you deliver to students that turn out to be incorrect; the review step exists for that reason.
8. Termination
We may suspend or terminate your account if you breach these Terms (especially the Acceptable Use Policy) or fail to pay. We'll give reasonable notice where possible.
9. Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind. Our total liability under these Terms is limited to the fees you paid in the 12 months preceding the claim. [CLARIFY: lawyer should confirm jurisdiction-appropriate limitation language for Republic of Korea.]
10. Governing law
These Terms are governed by the laws of Republic of Korea. Disputes will be resolved in the courts of Republic of Korea. [CLARIFY: confirm with lawyer.]
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after that constitutes acceptance.
12. Contact
For any questions about these Terms, email support@gurume.kr.
Privacy Policy
1. What we collect
- Account info: email, hashed password, plan, billing identifiers from Stripe.
- Uploads: markscheme PDFs and student answer PDFs you upload, along with metadata (filename, upload time, batch grouping).
- Marking output: annotated PDFs, structured marking JSON, handwriting transcriptions.
- Feedback: when you override an AI mark, we log the AI's value, your override, and any note — used to improve the marker.
- Usage data: standard server logs (IP, timestamp, endpoint). Used for security and debugging.
2. What we don't collect
- Card numbers — Stripe holds those. We see only the last 4 digits and brand.
- Tracking cookies for advertising. We use a single first-party session cookie for login.
3. How we use it
- To deliver marking output back to you (the core service).
- To bill you and prevent abuse / fraud.
- Aggregated, non-personal feedback data to iterate on AI marking accuracy.
- To send service-related emails (billing receipts, account changes). We do not send marketing emails without your opt-in.
4. Who we share with
- Anthropic — your markscheme + student PDFs are sent to Anthropic's API for AI processing. Anthropic's policy at the time of writing does not retain customer data for model training. (See anthropic.com/privacy.)
- Stripe — for billing. (See stripe.com/privacy.)
- Cloud hosting providers we operate the service on. [CLARIFY] list them after Step 3D deploy: e.g. Vercel, Render, Cloudflare R2.
- We do not sell your data. We do not share it with anyone else without legal compulsion.
5. Data retention
Markings, markschemes, and feedback are retained as long as your account is active. If you delete your account, we delete all your uploads and marking output within 30 days. Aggregated, anonymised feedback data may be retained beyond that for the purpose of improving the service. Server logs are retained for 90 days.
6. Your rights
You may request a copy of your data, correction of inaccuracies, or deletion of your account at any time, by emailing support@gurume.kr. Under PIPA (Korea) and GDPR (if you're in the EU), you have specific rights regarding access, rectification, erasure, restriction, and portability — exercise any of them by emailing the same address. [CLARIFY: PIPA/GDPR specifics with lawyer.]
7. Security
Passwords are hashed with bcrypt. Files are stored at rest in cloud object storage with provider-managed encryption. Access to production data is limited to Harry Lee and any explicitly-authorised team members. We'll notify you within 72 hours of becoming aware of a data breach affecting your information.
8. Children
The service is intended for teachers and tutors, not students or children directly. Don't create an account if you're under 16. (Note: student exam papers uploaded by their teacher are content about minors but are not their accounts; the teacher remains the data controller.)
9. Contact
For privacy questions or to exercise your rights, email support@gurume.kr.
Acceptable Use Policy
When using AI Marker, you agree not to:
- Upload markschemes, question papers, or other copyrighted material you don't own and don't have the right to use. The most common failure mode is uploading official examiner markschemes without an authoring/licence basis. Whenever possible, build markschemes yourself in the app rather than uploading copyrighted PDFs.
- Upload personal data of students beyond what's strictly necessary for marking (e.g. anonymised exam answer sheets are fine; full ID documents are not).
- Use the service to generate output for academic dishonesty, fraud, or commercial resale of marking output dressed as a competing service.
- Attempt to extract our prompts, reverse-engineer the marker, scrape other users' data, or DDoS the service.
- Bypass rate limits, run multiple accounts to evade quotas, or share credentials.
Reporting violations
If you believe content on the service infringes your copyright or violates this policy, email support@gurume.kr with details. We'll review and remove offending content where appropriate.
Consequences
Violations of this policy may lead to account suspension, deletion of offending content, and termination without refund.
